Personal Injury Claims in Seaham

Being in an accident can be a traumatic experience. We’re here to help you understand if you are entitled to a claim for compensation.

What is a Personal Injury claim & how long do you have to claim?

‘Personal injury’ is the legal term for an injury or illness that has been caused (or made worse) by someone else’s negligence. If you’ve suffered in these circumstances you may be able to make a personal injury claim to recover compensation from those responsible.

When it comes to how long you have to claim, you normally have three years to issue your claim.

The time limit starts from the date of your accident. However, in some cases it can be from the date you became aware your injury (date of knowledge). There are exceptions to the three year rule – and sometimes the time limit is shorter. If you think you might have a claim, it’s important to contact us as soon as possible.

How We Can Help & Support You

There are a variety of ways that you could have experienced an injury during your daily life. We are here to advise clients on their right to claim compensation if you have experienced an injury  due to negligence from another party.

You can find out more about the different types of personal injury claims we can support you with.

In the modern workplace accidents can occur in many ways. Regardless of the severity any accident can cause physical, mental and financial hardship for any injured person.

Employers have a very high duty of care to prevent accidents from occurring. Many employers fail in this duty. We can assess your case to see if we feel this would be a case we can act for you on.

Accidents which take place on property or land owned by somebody else are called Occupiers Liability Claims are they are very common.

Occupiers Liability claims often involve personal injury accidents which occur in buildings, on “premises” or on land which is not controlled by you or your employer. Premises includes not just business premises but other types of fixed and mobile premises ranging from a shopping centre or a Government building to an aeroplane, a ship, a bus or a train.

Many Occupiers Liability personal injury claims are for people who were injured whilst working, and the accident or injury took place on premises that was not controlled by their employer.

Throughout the course of your day, you can visit numerous ‘public places’ such as walking down the street, going for a haircut or visiting a tourist attraction.

These are all public places, and you have a right to enjoy them without the risk of being injured. In order to achieve this, the person, business or organisation responsible for the area must take reasonable steps to ensure the public’s safety.

If you suffer a personal injury in an accident, it may mean that whoever is responsible (liable) for that public place has failed to meet their duty to protect you. Exactly who should be held accountable for this will depend on the public place where the accident occurred.

Slips and trips can happen anywhere and at any time. Owners of land, shops, restaurants, bars, nightclubs and any other property encouraging footfall have a duty to maintain their premises, highlight defects and  maintain a reasonable system of inspection in order to avoid accidents from occurring.

The Defective Premises Act 1972 allows the owner or tenant of a defective residential property to submit a claim under the Act if the defect existed when the dwelling was built, and as a result the property is deemed unsuitable for human habitation.

Road traffic accidents are extremely common. Most people experience being involved in at least one during the course of their lifetime. Any injuries that are caused by being involved in a road traffic accident can be severe and can affect you for years or sometimes for your whole life. These accidents can also affect you psychologically.

If you are a driver, a motorcyclist, a pedestrian, a cyclist or any other road user you may be entitled to compensation. Even if the accident was caused by an uninsured or untraced driver you may still be entitled to compensation.

When you visit a beauty salon, you expect a professional service from trained staff. When this isn’t the case, a routine treatment can end up causing you harm. If you’ve suffered an injury at a beauty salon, we can help.

The lack of regulations in the beauty industry means that salon staff can use equipment and perform treatments without proper training or experience. If you’ve suffered an injury as a result of negligent treatment by a beauty therapist, we can help you claim compensation.

The CICA (Criminal Injuries Compensation Authority) is a government body set up to compensate victims of violent crime and abuse. The purpose of the scheme is to compensate victims who may not be able to claim against those responsible for causing their injuries.

The limit on CICA claims is 2 years from the date of the incident.

If you’ve been the victim of a violent crime or abuse, you may be able to claim through the CICA, feel free to reach out to find out more.
